Maricopa County Declares No Charges for Brady Kiser in the Tragic Pool Drowning of His Son, Trigg

In a heartbreaking case that captivated public attention over the summer, Maricopa County Attorney Rachel Mitchell announced on July 25, 2025 that Brady Kiser the husband of social media influencer Emilie Kiser will not be charged with felony child abuse in connection with the death of their 3‑year‑old son, Trigg. The decision followed a thorough review that found no reasonable likelihood of conviction despite a prior recommendation from Chandler police to bring charges.,


On May 12 Brady was at home in Chandler, Arizona, caring for both Trigg and their newborn son, Theodore, while Emilie was reportedly socializing with friends. During this time he lost sight of Trigg for approximately three to five minutes. When he returned to the backyard he found Trigg unresponsive in the family’s pool.


The toddler was airlifted to Phoenix Children’s Hospital but tragically passed away on May 18, following six days in critical condition. Chandler Police concluded their investigation and formally recommended charging Brady with a Class 4 felony child abuse offense, citing the brief lapse in supervision as the basis.


Under Arizona law the prosecution would need to prove that Brady’s behavior constituted criminal negligence, a “gross deviation” from what a reasonable person would entail. However, after the Maricopa County Attorney’s team including senior attorneys and the county attorney herself conducted a detailed assessment of evidence, they concluded the case did not meet the stringent standard required for criminal prosecution.


Brady’s legal representative, Flynn Carey, expressed gratitude that the tragedy was reviewed carefully and reaffirmed that it was ruled a tragic accident based on available evidence. He emphasized that Brady remains in active mourning and is focused on supporting his family through grief in the weeks following the loss.


Parallel to the legal developments, Emilie Kiser pursued legal action to prevent public access to case-related records. She filed a petition in late May seeking to seal surveillance footage, autopsy materials, her personal declarations, and other documents, citing the trauma endured and the desire to protect her surviving child. In early June a court granted temporary confidentiality, shielding sensitive disclosures from public scrutiny while the matter remained under review.


This unfolding narrative illustrates a painful intersection of public life and private tragedy. Emilie Kiser, renowned for her influencer presence across TikTok and Instagram, has faced intense levels of public interest after her son’s death. According to insiders, she has received over 100 separate requests for records related to the incident requests she deems driven by morbid curiosity rather than genuine insight or accountability.


While no charges will be filed, this chapter is not closed. The court still considers final rulings on Emilie’s bid for full privacy. Meanwhile the family continues to process profound grief.
